DESCRIPTION OF SERVICES

OSMOBI is a web service that makes Drupal and Joomla! sites accessible on mobile communication devices with great ease and great power. OSMOBI repurposes the content of desktop websites to give mobile visitors an easy, intuitive and comfortable mobile browsing experience, regardless the device they use. The OSMOBI platform is optimized for Open Source CMS’s Joomla! and Drupal. OSMOBI is powered by the SIRUNA technology. SIRUNA is a mobile technology innovator, helping companies make online content available on any type of mobile device. SIRUNA solutions are based on powerful, self-developed Open Source technology.

OSMOBI offers a free service (OSMOBI Free), which allows users, after completing the registration form, to swiftly and easily mobilize their website or blog. This free service includes basic tools such as instant mobilization of Drupal and Joomla! sites, editing of layout and content, integration of Google Analytics, etc.

OSMOBI also offers a paid service (OSMOBI Premium) which offers advanced tools (such as integration with mobile advertising platform, Native iPhone Look & Feel, creation of webclip icon), unlimited number of visitors and service support from SIRUNA.

You may view, download and copy information and materials available on this website solely for your personal, non-commercial use. BETA TESTING DISCLAIMER

SIRUNA offers beta testing to customers interested in its new OSMOBI service, its features, and modules. If a customer uses a product during beta testing, the customer is asked to provide feedback to SIRUNA and assumes all risks associated with the beta software. We advise all beta users to use extreme care when beta testing any OSMOBI software. It is therefore up to you to take necessary precautions against possible damages resulting from any beta testing. Software in beta testing should not be used on sensitive and/or valuable data.

Beta Software Testor Agreement: Testor acknowledges and agrees that SIRUNA offers software “as is” without warranty of any kind. SIRUNA shall have no obligation to maintain, correct, update, change, modify or otherwise support the software in beta testing. SIRUNA may discontinue providing service to the software at any time. SIRUNA makes no guarantee or commitment as to the success of the software.

Beta testing is at the entire risk of the customer, not SIRUNA. Should the software prove defective the customer assumes the costs of all necessary corrections, repairs and damages. SIRUNA shall not be liable for any lost revenue, lost profits, or other incidental or consequential damages even if advised of the possibility of such damages by reason of any performance or non-performance under this agreement. Furthermore, SIRUNA shall not be liable for any delays, losses or other damages which may result from the furnishing or canceling of any OSMOBI software, features, and/or modules.

TERMINATION OF USE

SIRUNA may, in its sole discretion, terminate or suspend your access to all or part of the OSMOBI website, including, but not limited to any bulletin boards on its site, for any reason, including without limitation, breach of this agreement. In the event this agreement is terminated, the restrictions regarding materials appearing on the site and the representations and warranties, indemnities, and limitation of liabilities set forth in this agreement shall survive any such termination.

GOVERNING LAW, JURISDICTION AND VENUE

This Agreement shall be governed by and construed in accordance with the laws of Belgium exclusive of its choice of law principles. The courts of Ghent shall have exclusive jurisdiction and venue over any dispute arising out of or relating to this Agreement, and each party hereby consents to the jurisdiction and venue of such courts.

GENERAL PROVISIONS

If any provision of this agreement is deemed void, unlawful or otherwise unenforceable for any reason, that provision shall be severed from this agreement and the remaining provisions of this agreement shall remain in force.
